In consideration of the risk of injury while participating in the Activity, and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter this waiver and release of liability. I waive any and all rights, claims, or causes of action of any kind whatsoever arising out of my participation in the Activity, and I release and forever discharge The LP Business LLC and/or www.betterconsumerreports.com, including their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns, from any physical or psychological injury, including but not limited to illness, paralysis, death, damages, or emotional or economic loss that I may suffer as a direct result of my participation, including travel to and from related events.

I AM PARTICIPATING VOLUNTARILY AND ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH TRAVELING TO AND FROM, AS WELL AS PARTICIPATING IN, THE ACTIVITY. THESE RISKS MAY INCLUDE, BUT ARE NOT LIMITED TO, PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY RESULT FROM NEGLIGENCE, CONDITIONS RELATED TO TRAVEL, OR THE LOCATION OF THE ACTIVITY. STILL, I ACCEPT ALL THE KNOWN AND UNKNOWN RISKS INVOLVED IN MY PARTICIPATION, INCLUDING TRAVEL.

I AGREE TO INDEMNIFY AND HOLD HARMLESS LP Business Consulting LLC AND/OR www.betterconsumerreports.com against any claims, lawsuits, or actions for liability, damages, or compensation brought by me or anyone acting on my behalf. If litigation occurs, I will be responsible for all attorneys’ fees and related costs, and I agree to reimburse LP Business Consulting LLC and/or www.betterconsumerreports.com for these expenses.

I recognize that LP Business Consulting LLC and/or www.betterconsumerreports.com, along with their directors, officers, volunteers, representatives, and agents, are not responsible for errors, omissions, acts, or failures to act during any event or activity conducted on behalf of LP Business Consulting LLC and/or www.betterconsumerreports.com.

I ACKNOWLEDGE THAT THIS ACTIVITY MIGHT TEST MY PHYSICAL AND MENTAL LIMITS AND COULD INCLUDE THE RISK OF DEATH, SERIOUS INJURY, OR PROPERTY LOSS. THE RISKS MAY BE CAUSED BY TERRAIN, WEATHER, FACILITIES, PARTICIPANTS, EQUIPMENT, TRAFFIC, OR THE ACTIONS OF OTHERS, INCLUDING BUT NOT LIMITED TO PARTICIPANTS, VOLUNTEERS, SPECTATORS, COACHES, OFFICIALS, AND PRODUCERS.

I CERTIFY THAT I HAVE READ THIS “DISCLAIMER, WAIVER AND RELEASE,” FULLY UNDERSTAND THAT IT RELEASES ALL LIABILITY, AND EXPRESSLY AGREE TO DISCHARGE AND RELEASE LP Business Consulting LLC AND/OR www.betterconsumerreports.com, AS WELL AS THEIR AFFILIATES, FROM ALL CLAIMS OR CAUSES OF ACTION. IN THE CASE OF MEDICAL CARE OR TREATMENT, I AGREE TO BE RESPONSIBLE FOR ALL COSTS. I UNDERSTAND I SHOULD HAVE MY HEALTH INSURANCE.

IF MY ACTIONS OR MY FAMILY’S ACTIONS DAMAGE EQUIPMENT OR FACILITIES DUE TO NEGLIGENCE OR RECKLESSNESS, I AGREE TO BE LIABLE FOR ALL COSTS ARISING.

THIS AGREEMENT IS ENTERED INTO FREELY, WITHOUT DURESS, AND AS A BARGAIN BETWEEN EQUAL PARTIES. BOTH PARTIES AGREE THAT THE TERMS ARE CLEAR AND THAT NO OTHER EVIDENCE OR EXPLANATION WILL BE USED TO ALTER THE TERMS; THE AGREEMENT WILL BE INTERPRETED BASED ON ITS LANGUAGE AND PURPOSE.

IF ANY PART OF THIS RELEASE IS FOUND UNENFORCEABLE OR INVALID, THE REMAINING PORTIONS STILL APPLY, UNLESS THE REMOVAL AFFECTS THE CONTRACT’S INTENT. IF A COURT SEES ANY PART AS UNENFORCEABLE BUT CAN BE MADE VALID BY LIMITING IT, THAT PART WILL BE ENFORCED AS LIMITED.

I AFFIRM THAT I AM AT LEAST 18 YEARS OLD AND THAT I AM SIGNING THIS OF MY OWN FREE WILL. I HAVE READ AND UNDERSTOOD THIS AGREEMENT, AND I KNOW THAT IT RELEASES LIABILITY AND IT IS A CONTRACT.
